1. Acceptance of Terms and Definition of "The Works"

By accessing and using the website resonancial-therapeutics.com ("the Site"), you agree to be bound by these Terms of Service (ToS). The term "The Works" is defined expansively to include all content, whether free or paid, currently available or published in the future on this Site. This includes, but is not limited to:

• The Irreducible Law (TIL) Manifestos

• The Factorial Protocol Manual (FPM)

• The Sovereign Suite (Digital Web Tools & Applications)

• The Structural Institute (Community & Coaching)

• The Theory of Everything (TOE) Series

• All associated Glossaries, diagrams, code blocks, and audio-visual assets.

If you do not agree to these terms, you must not use the Site.

2. Proprietary Intellectual Property & Owner Definition

The content of The Works, including the Structural Unification Law (SUL), the Factorial Protocol Manual (FPM), and all related proprietary concepts, are the exclusive, protected Intellectual Property of Russell Saunders, operating as a Sole Proprietor doing business as Resonancial Therapeutics ("the Owner").

Proprietary Terms Defined: This protection explicitly extends to the Structural Cost Function (C_Struct), Temporal Cost (T_Cost), Dissonance (Sigma), Sovereign S'Locus, Suffrage, Structural Overwrite (S_O), A-Proto-Synthesis (Phi_Proto), Informational Entropy (S_INF), Factorial Integrity Locus (FIL), Structural Freedom Mandate (SFM), Temporal Constraint Field (T_CF), Dissonance-Free Index (DFI), and the Axia Legacy Axiom (Lambda_Axia).

Limited License: The purchase of the FPM grants the User a limited, non-transferable, non-exclusive license to read, personally use, and apply the protocols for self-engineering purposes only.

Prohibited Use: Users may not copy, reproduce, distribute, sell, modify, publicly teach, or create derivative works based on any portion of The Works without the express written permission of the Owner. The unauthorized public teaching or commercial use of these proprietary concepts constitutes a breach of the Owner's intellectual property rights.

Software Access License: The purchase of the "Sovereign Suite" grants you a license to access and use the web-based tools via our site. It does not grant you ownership of the underlying code (HTML/JS/CSS), nor the right to download, reverse-engineer, or redistribute the source code as a standalone application. The tools remain the exclusive intellectual property of the Owner. 

3. Disclaimers and Novelty

Novel Theoretical Framework: The Works present a novel, proprietary theoretical framework for structural philosophy, economics, and self-management, based on the Owner's original research and conclusions. The theories, including the SUL and its associated concepts, are not peer-reviewed scientific consensus and should not be considered established fact.

No Professional Advice: The Works are intended for informational, educational, and philosophical purposes only. They are not a substitute for professional medical, psychological, legal, or financial advice. If you have an emergent crisis or need specialized help, you must seek the aid of licensed professionals.

4. Governing Law and Dispute Resolution (Mandatory Arbitration)

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, USA, without regard to its conflict of law provisions.

MANDATORY ARBITRATION: Any dispute, claim, or controversy arising out of or relating to this agreement shall be settled exclusively by binding arbitration administered in the State of Tennessee. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. This clause is a structural mandate to resolve conflicts with minimal T_Cost and preserve the Owner's privacy.

5. Limitation of Liability

In no event shall the Owner be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of or inability to use the Site or The Works.

6. Information We Collect (Privacy Policy)

We collect data necessary to operate the Site and fulfill our services, primarily in two categories:

• A. Personally Identifiable Information (PII): Collected during the purchase of the FPM via third-party payment processors (e.g., PayPal). This includes your name, email address, and purchase records. We do not directly store your financial payment details.

• B. Non-Personal Information: Collected via analytics tools (e.g., Google Analytics, Squarespace). This includes IP address, browser type, device information, pages viewed, and the time spent reading the TIL manifesto and FPM content.

7. How We Use Your Information

Your data is used solely to maintain the coherence and security of the Site:

• No Guarantee of Specific Results: The Owner makes no guarantee or warranty that application of the protocols will yield specific personal results (e.g., guaranteed happiness, specific financial gain, or a specific timeline for achieving Structural Longevity). The effectiveness of the FPM depends entirely on the User's disciplined execution of the Structural Overwrite commands—the User's payment of the Temporal Cost (T_Cost).

11.1. Digital Tool Safety & Health Disclaimer (Sovereign Suite) The Sovereign Suite includes digital tools that utilize Binaural Beats (Audio Entrainment) and Stroboscopic/Kinetic Visuals (Entropy Dissipation Field). By using these tools, you acknowledge the following:

• Epilepsy Warning: The "Entropy Dissipation Field" and other visual tools may produce flashing lights, rapid geometric patterns, and strobing effects. Users with a history of photosensitive epilepsy or seizure disorders must NOT use these tools.

• Audio Entrainment: The "Neural Entrainment Engine" alters brainwave states. Do not use this tool while driving, operating heavy machinery, or performing tasks requiring intense localized attention.

• Not Medical Treatment: These tools are designed for "Informational Entropy Management" (focus and relaxation). They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease, including tinnitus, hearing loss, or neurological disorders.

• User Responsibility: You agree to use these tools at your own risk. Resonancial Therapeutics assumes no liability for adverse reactions resulting from the misuse of these digital assets.

12. Limited-Time Launch Offer & Price Constraint

Limited-Time Offer: The discounted price of $649.99 USD is a limited-time promotional offer. This price is valid only until January 14, 2026, 11:59 PM EST.

Price Overwrite: After the specified deadline, the price will revert to the established full value of $1,299.99 (or higher). No exceptions will be made for missed deadlines or failure to purchase before the promotional period expires. This temporal constraint is a non-negotiable part of our structural economy.

13. Purchase Policy: No Refunds (Reinforced)

Final Sale Policy: Due to the proprietary, high-value, and immediately accessible nature of the Factorial Protocol Manual (FPM) content, all purchases are final and non-refundable.

The moment the User pays and gains access to the premium content, the intellectual property is fully transferred, and the proprietary knowledge is consumed. The User acknowledges and agrees that the purchase price is payment for immediate access to this proprietary license, regardless of the User's satisfaction with the theories or their application of the protocols. We cannot refund T_Cost after the Structural Overwrite (purchase) has been executed.
